Terms of Service
1. Platform Services
Boekie operates as a booking platform that facilitates reservations between customers and participating organizations (restaurants, venues, etc.). We provide the technology and platform to connect customers with these organizations but are not directly responsible for the services provided by these organizations.
2. Booking Service Disclaimer
By using our platform, you acknowledge and agree that:
- Boekie acts solely as an intermediary platform between customers and organizations
- All bookings, reservations, and services are the direct responsibility of the participating organizations
- Any issues, disputes, or complaints regarding actual service delivery must be addressed directly with the relevant organization
- We do not guarantee the quality, safety, or accuracy of the services provided by participating organizations
3. User Responsibilities
As a user of our platform, you agree to:
- Provide accurate and complete information when making bookings
- Comply with the specific terms and policies of participating organizations
- Honor your bookings or cancel them in accordance with the organization's cancellation policy
- Not use our platform for any unlawful or unauthorized purposes
4. Limitation of Liability
Boekie shall not be liable for:
- Any direct, indirect, or consequential damages arising from the use of our platform
- The quality, safety, or satisfaction of services provided by participating organizations
- Any disputes between users and participating organizations
- Cancellations, modifications, or refunds related to bookings
5. Platform Usage
We reserve the right to:
- Modify or discontinue any aspect of our platform at any time
- Suspend or terminate user accounts that violate these terms
- Update these terms of service as needed
6. Intellectual Property
All content, features, and functionality of our platform are owned by Boekie and are protected by international copyright, trademark, and other intellectual property laws.
7. Dispute Resolution
Any disputes regarding platform functionality should be directed to Boekie. However, disputes regarding actual services must be resolved directly with the participating organization.
8. Protection of Personal Information (POPIA)
Boekie provides a reservation system used by restaurants and other venues in South Africa. When you make a booking, your personal information is processed under the Protection of Personal Information Act 4 of 2013 ("POPIA"). By ticking the acceptance box on the reservation form, you acknowledge this notice and accept that your information is collected and stored to provide the reservation.
Who is responsible
- The venue you book with is the responsible party for the personal information needed to take, hold, and manage your reservation.
- Boekie processes that information as an operator for the venue, and as a responsible party for running, securing, and supporting the reservation platform.
- Questions about the platform can be sent to privacy@boekie.co.za. Questions about how the venue uses your information after the booking should be sent to the venue.
What we store, and why
We collect and store only what is needed to provide the reservation service:
- Your name, email address, and cell number, so the booking can be confirmed and the venue can contact you about it
- Party size, date, time, and any table or seating choice
- Notes you choose to give, including dietary or allergy information, used only so the venue can prepare for your visit
- A booking reference, and payment references where the venue requires a fee or deposit. Card details are handled by the payment provider
- Records of changes, cancellations, and no-shows, so the reservation can be administered
This information is required to complete a reservation. If you do not provide it, or you do not accept this processing, the booking cannot be made. Marketing messages are separate and are sent only if you opt in on the reservation form. You can unsubscribe at any time.
Lawful basis
We process this information because:
- You consent by ticking the acceptance box when you submit the reservation
- It is necessary to conclude and carry out the reservation you asked for
- It is in the legitimate interests of Boekie and the venue to operate the booking, reduce no-shows, prevent fraud, and keep a record of the reservation
- A legal duty may require certain payment or accounting records to be kept
Your personal information will not be used for a purpose that is incompatible with providing the reservation, unless POPIA allows it or you agree. Dietary and allergy notes are processed only because you provided them, and only for that visit.
Who receives it
Your reservation details are shared with:
- The venue, so it can seat you and provide the service you booked
- Providers who send the confirmation email or SMS, host the platform, or process a payment, and only for that task
- A point-of-sale or similar system the venue uses to run its service, where that venue has connected one
We do not sell your personal information.
How long it is kept
Reservation records are kept for as long as needed to provide the booking, handle changes and disputes, and meet any legal retention duty. They are then deleted or de-identified. The platform may store information on servers outside South Africa. Where it does, the recipient is bound by a law, binding corporate rules, or an agreement that provides protection substantially similar to POPIA.
Security
Boekie and the venue must take appropriate, reasonable technical and organisational measures to protect your personal information against loss, damage, unauthorised access, and unlawful processing.
Your rights
You may ask to:
- Access the personal information held about you
- Correct information that is inaccurate, incomplete, or out of date
- Delete information where the law allows it
- Object to processing. If the reservation cannot be provided without that information, the booking may not be kept
